These terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you”) with YAWN through Whiteley Buro Ltd (“YAWN” “us” or “we”), at Yawn Online (www.loveyawn.com - also referred to as the “website”) hereinafter referred to as the “Terms and Conditions”. Please read our Terms and Conditions carefully before placing any orders on www.loveyawn.com. By placing an order, you enter into an agreement with us and accept these Terms and Conditions. We may modify the Terms and Conditions from time to time. If you do not agree to any change to the Terms and Conditions then please immediately stop using the website. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.
1. HOW TO SHOP ONLINE
a. Shipping country
When you enter www.loveyawn.com we will detect the country you are browsing from and this will be pre-selected as your shipping destination. You can change country at any time before the final check-out step.
YAWN online store only offers products that we have in stock and that are published on www.loveyawn.com. Browse the site to select the items you like and add them to your shopping bag. Please note that all orders are subject to availability, and items in your shopping basket are not reserved and may be purchased by other customers until you have completed all checkout steps.
You can always view, change or delete items in your shopping bag before you proceed to the checkout.
To be able to place an order from the website you will be asked whether you would like to register and provide your personal details. If you would like to register you must provide your real name, phone number, e-mail address and other requested information as indicated. Please note that we do not ship to P.O. box addresses or sell to companies, only private individuals. You are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please update your personal details at www.loveyawn.com or notify us immediately by calling YAWN Customer Service or via email email@example.com . We may change registration requirements from time to time.
Your username on www.loveyawn.com will always be the email address you entered when registering. The account password you provide should be unique and kept secure, and you must notify YAWN Customer Service immediately of any breach of security or unauthorised use of your account.
c. Submitting your order
Before proceeding to payment, you can review your order (including your total price inclusive of VAT and shipping charges) and make changes if needed.
You are bound by your order from the moment you accept the online offer of YAWN and the conditions thereby stipulated have been fulfilled (once the order has been submitted and payment confirmed on the website or via YAWN Customer Service order via telephone). Please note that the order will not be valid if YAWN cannot confirm the billing and shipping addresses that you provide. We also reserve the right to only accept orders from those aged over 18 years old.
Orders must be placed online or via telephone to Customer Service. YAWN do not accept orders via email.
Payment towards online store purchases can be made with a valid card by a provider accepted by YAWN online or with a PayPal account. You will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided. YAWN reserves the right to restrict multiple quantities of an item, or of orders, being shipped to any one customer or postal address.
The same payment terms apply to customers placing their order online as well as via telephone. We do not accept orders via email.
e. Order confirmation
You will receive an immediate online confirmation on your screen at the end of the checkout, as well as an email confirmation of your order from YAWN.
f. Changes to your placed order We aim to be really fast at picking and packing, so please note that once your order has been placed and you have received an order confirmation email, you may not make any changes to your order. If you wish to make changes to your placed order, or if there is any mistake made in registering customer contact or address details when placing the order, it is your responsibility to contact YAWN Customer Service immediately.
2. PRICING POLICY AND CHARGES
Prices are shown in British pound (£/GBP) for shipments to addresses in the UK.
All prices displayed in the YAWN online store include country specific Value Added Tax (VAT) and exclude shipping fees. The shipping fees will be added to the order in the checkout step and might differ based on which country your order is shipped to. You can select shipping country when entering or browsing the website, or when entering your details in the checkout step. Please find more information about our delivery charges for each country under section 4 (Delivery and Shipping).
Orders can be processed online or via the telephone.
Orders placed against a PayPal account can only be processed online. We only accept cards with billing addresses in one of the countries that YAWN Online ships to. Please note that we cannot accept any other payment methods.
When paying by card or PayPal, YAWN reserves the right to check the validity of the card or PayPal account, that there is enough funds to cover the purchase sum, and validate the billing address details of the purchaser. YAWN reserves the right to deny any purchase. Your card or PayPal account will only be debited after your order has been dispatched from the warehouse. The currency used is £/GBP for the UK. VAT is included in all our prices and will be updated on the online store, when you select shipping country.
Please note that all prices and product information on loveyawn.com are subject to change. If you are a UK customer whose card or PayPal account is not denominated in British pounds (£), the final transaction amount will be calculated in accordance with the applicable exchange rate on the day your card issuer or PayPal processes the transaction.
4. DELIVERY AND SHIPPING
Select the country where you would like your items to be delivered at the top of the web page, under “Shipping to”. If you have already added items to your shopping bag they will not disappear if you change your shipping destination. You can change the shipping destination before you reach the checkout. Please note that all prices, VAT, delivery times and delivery charges will be adjusted depending on the country you would like your items shipped to.
Shipping fees in £ (GBP) will be displayed in checkout if they apply.
YAWN will take the greatest of care to be as accurate as possible when receiving and dispatching orders.
YAWN will dispatch the approved orders as quickly as possible and in the order that they have been received. Delivery normally takes about 1-2 working days (Monday – Friday) from the time of placing the order. Delivery times may vary depending on where the order is to be delivered, though the latest within 30 days from order date.
Please note that we only sell items that we have in stock. Garments may sell out during the shopping session, and stock availability will be updated once you reach the checkout. We aim to dispatch all orders within 24 hours (Monday – Friday) with the exception of sale and peak periods where this may take longer. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. YAWN is not responsible for any delays caused by destination customs clearance processes.
If a delivery suffers a delay or if the delivery cannot be dispatched or only partially due to the goods not being in stock or other reasons, the consumer will be informed about this as quickly as possible or at the latest 30 days after the order was placed. In this case, the consumer will be given the option and has a right to terminate the agreement, free of charge. In the case of termination in accordance with this paragraph, YAWN will refund the consumer with the sum paid as quickly as possible, though at the latest within 30 days after termination.
The place of delivery is deemed to be the address that the consumer makes known to YAWN at the time of registering personal details and placing the order.
Please note that we only ship to home or office addresses and not to P.O. box addresses.
5. RIGHT OF RETURN/CANCELLATION
a. Our policy
You have the right to cancel your purchases within a period of 14 calendar days after the day of delivery of the goods which means that you are allowed to change your mind and send back the goods you have received, without any obligations from your side. We trust that you will treat the product and its packaging with care - please return items undamaged and unused, with all YAWN labels and tags intact.
Returns that are damaged or soiled, washed, altered or worn (other than to try the item on) may not be accepted and may be sent back to the customer and/or a refund refused.
Once your return has been received, we aim to process it as quickly as possible. Please note that at peak times, it may take us longer than usual to process your return, up to 21 days. We will let you know when we receive and approve your return. Then we’ll issue a refund by the same payment method as your order within 30 days of you posting the return, or confirm and send the item you would like in exchange. Please remember that financial responsibility for the return is yours until it reaches us, so we recommend that you use a registered delivery service.
If you would like to exchange the same item for a different colour or size, you can do so by filling in the designated section on the delivery note. The new item must be the same price or lower - if it is lower, you will receive a refund of the difference within 30 days of us receiving the unwanted item.
Delivery of the new item will be free of charge.
c. Faulty goods
Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty. If you are returning a faulty item, you are entitled to a full refund including costs for return.
We have made every effort to display as accurately as possible the colours of our products that appear on loveyawn.com. If there are colour differences between the colours shown on the website on your computer and the actual colours of the garments, this may be due to the colour reproduction on your computer.
7. TRANSPORT WARRANTY
All consignments that are sent are insured by YAWN. If you discover any damage to the package before you open it, you must report this to the forwarding company. If you have already opened the consignment when you discover the damage, you must follow the instructions on the back of the return note that is attached to the consignment. Damaged goods are replaced free of charge by YAWN.
8. MINIMUM AGE
In order to shop at YAWN online store you must be at least 18 years old.
9. PROTECTION OF PRIVACY
The Data Protection Act 1998 sets out requirements for how we store and disclose your personal information. YAWN assumes responsibility for all personal information that you make available to us. The details are used for verifying, accepting and processing delivery agreements and for managing the customer relationship thereby arising, pursuing outstanding payments, combatting fraud and misuse and complying with statutory regulations. The information is also used with your consent for YAWN’s marketing activities.

10. APPLICABLE LAW
These Terms and Conditions and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any purchase on the website shall be governed by UK law.
If any local mandatory consumer law provisions are applicable, YAWN will consider such provisions and make country specific adjustments. YAWN may modify or amend these Terms and Conditions at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.
11. OWNERSHIP OF RIGHTS
All rights, including copyrights at loveyawn.com remain with Whiteley Buro Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
With your permission, if you opt into our emails we may send you emails about Yawn, our new products and any other updates that we think may be of interest.

SECTION 3 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is
complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. Our store uses Google Analytics to help us learn about who visits our site and what pages are being looked at. This helps us to create a better experience at Yawn for all our customers.
SECTION 6 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
